These terms govern your use of colepowerconsulting.com ("the site"). By using the site, you agree to them. If you don't, please don't use the site.
About this site
The site is informational. Submitting a Sell, Buy, or Contact form creates an opportunity for Cole Power Consulting ("CPC") to respond with information or an offer. It does not create a binding contract for the sale or purchase of equipment. Any transaction is documented separately, with terms specific to that transaction.
Equipment transactions
CPC facilitates transactions in industrial and commercial power generation equipment. We do not warrant or guarantee the condition, performance, or fitness for purpose of any equipment we sell or facilitate the sale of, unless explicitly stated in a separate written agreement covering that specific transaction. Equipment specifications are provided by sellers and verified by us in good faith; buyers are encouraged to inspect equipment prior to purchase.
Accuracy of information
We make a good-faith effort to keep information on the site accurate and current. We do not guarantee that every detail is correct at every moment, particularly with respect to inventory availability, market pricing, or technical specifications quoted on summary pages. For transaction-specific information, the prevailing source of truth is the written quote or appraisal we provide to you directly.
Intellectual property
The site's design, text, graphics, and trademarks (including the CPC monogram and "Cole Power Consulting" wordmark) are owned by Cole Power Consulting. Equipment manufacturer names mentioned on the site (Caterpillar, Cummins, Kohler, etc.) are trademarks of their respective owners and are referenced solely to describe the equipment we work with.
External links
The site may link to third-party resources (e.g. industry standards like NFPA 110). We're not responsible for the content or accuracy of external sites.
Limitation of liability
To the maximum extent permitted by law, CPC is not liable for indirect, incidental, or consequential damages arising from your use of the site or reliance on information published here. Liability arising from any transaction is governed by the written agreement covering that transaction.
Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute relating to the site or these terms will be resolved in the state or federal courts located in Dallas County, Texas.
Changes
We may update these terms. The "Last updated" date at the top of the page changes when we do. Continued use of the site after a change indicates acceptance of the revised terms.
